If you are in the UK and have received refusal then you will have 14 days to file an appeal. For applicants who are outside the UK, the appeal needs to be filed in 28 days from the date of receipt of the refusal notice.
Yes, you are required to make an extra payment for the appeal and the amount will vary if you are making an oral appeal or on the basis of documents.

Any applicant for UK spouse visa must meet the following requirements:

  • Be 18 years old or over
  • Must be married or in civil partnership which is legally recognised under UK law.
  • Must be married to or in a relationship with a British citizen or settled person.
  • If you are living together in a relationship as a couple for at least 2 years and can evidence the same.
  • If you are engaged and want to be married in UK, you will be granted ‘Fiancé Visa UK’ – you will have to evidence that you plan to get married within 6 months of entering the UK.

All the applicants for UK spouse visa will have to prove that they can meet English language requirement.

This can be met in different ways viz:

  • having a degree from UK University
  • having a degree that was taught in English outside the UK
  • taking the English language test

There could be other ways in which this requirement can be met.

An amount of £62,500 held by the applicant, their partner or both jointly for at least 6 months prior to the date of application can be counted toward the financial requirements. However, an applicant can combine the annual gross income with savings. A spouse visa applicant can also use a minimum savings threshold of £16,000, and additional savings of an amount equivalent to 2.5 times the amount which is the difference between the gross annual income from the permitted legal sources including a gift from a family member or other third party, provided the source of the cash savings is declared.

Where the cash savings held at the date of application are the proceeds of an applicable property sale; the period the property was owned in the 6 months prior to the date of application before it was sold to produce cash savings, can be counted towards the 6 month period. So money held as cash savings at the date of application can have resulted from the sale of a property for the first part of the period of 6 months prior to the date of application and as cash savings for the rest of that 6 month period.

All the applicants who plan to stay in the UK, will have to prove that they can meet English language requirement . When you have cleared and passed an English Language Test, the maximum validity is two years.You will have to appear for an English test in speaking and listening to get the official right to live in the UK with your spouse. Your test qualification will only be valid if your English exam for UK Spouse Visa is taken via approved Secure English Language Testing (which is also known as SELT) Provider.

Note: Currently, Secure English Language Testing (SELT) tests for UK Spouse visa immigration purposes are only taken through the Trinity College, London or the IELTS which is also known as(International English Language Testing System)

Note that you do not need an English Language test for UK Spouse Visa if you:

  • Are a citizen from a “majority English speaking country”.
  • Are below 18 years, or above 65 years old.
  • Suffering from a long term physical disability or mental condition
  • If you hold a degree that was taught in English.
