Who is an EEA Family Permit Direct Family Member?

According to the British Immigration law, the following people can be considered as direct family members of an EEA national:

  • Spouse or Civil Partner;
  • Direct descendants of the EEA national or their Spouse or Civil Partner who are:
    1. Under the Age of 21
    2. Dependents of the EEA national or their spouse or civil partner
  • Dependent direct relatives in the ascending line of the EEA national or their spouse or civil partner

In the event that the EEA national sponsor is a student and has been a resident in the UK for more than 3 months, their family member will only have a right to reside (or a right to be considered a ‘direct family member’) if they are either:

  • The dependent child of the EEA national or the EEA national’s spouse or civil partner.
  • A qualified persona in their own right.
