It’s uncertain times in the UK, albeit temporarily. One should expect the rules and policies in the UK, especially when it comes to immigration, to be changing at frequent intervals. Keeping that in mind, let us look at the technical aspect of the immigration rules of the UK the way they stand today, to understand whether or not you can be considered as an EEA Family Permit Direct Family Member. For straight to your inbox updates on any new changes or amendments in the UKVI rules, send an email to email@example.com with the subject line ‘Brexit’.
Now, are you eligible for the European free movement rights based on your relationships with an EEA national? Let’s find out.
According to the British Immigration law, the following people can be considered as direct family members of an EEA national:
- Spouse or Civil Partner;
- Direct descendants of the EEA national or their Spouse or Civil Partner who are:
- Under the Age of 21
- Dependents of the EEA national or their spouse or civil partner
- Dependent direct relatives in the ascending line of the EEA national or their spouse or civil partner
In the event that the EEA national sponsor is a student and has been a resident in the UK for more than 3 months, their family member will only have a right to reside (or a right to be considered a ‘direct family member’) if they are either:
- The dependent child of the EEA national or the EEA national’s spouse or civil partner.
- A qualified persona in their own right.
If you do not fit one of the above listed criteria, then you should consider the provisions relating to extended family members. Click here for guidance on the same. If you require assistance on the matter, feel free to fill out the form on the side with your query, and one of our legal immigration experts will be in touch with you shortly with the best answer to your query.
If on the other hand, you do meet the requirements to be an EEA Family Permit direct family member, the successful application of the same would entitle you to an automatic right of residence in the UK for as long as they remain a family member of the EEA national.
