The Nationality and Borders Act will dissuade unlawful immigration into the UK, disrupting people-smuggling networks’ business model, and expedite the expulsion of those who have no right to be in the country.

As a result, Borders Act to overhaul Asylum System is now a law. The asylum system will be freed up, allowing the UK to better assist individuals in actual need of asylum through safe and legal channels.

Furthermore, the legislation makes it legal for anyone who enters the UK illegally – even if they could have sought asylum in another safe nation – to be regarded as “inadmissible” to the UK asylum system.

Priti Patel, Home Secretary of the United Kingdom quoted

  • “This is a huge milestone in our commitment to our promise to the British public – a fair but firm immigration system”.
  • “While there is no single solution to the global migration crisis, these new laws are the first step in overhauling our decades-old, broken asylum system”.
  • “We will now work tirelessly to deliver these reforms to ensure we have an immigration system that protects those in genuine need while cracking down on abuse of the system and evil people-smuggling gangs”.

These important improvements will be implemented alongside a slew of other new initiatives, including

  • Stricter penalties for people smugglers, including a sentence of life in prison, and a 4 year sentence for illegally entering the UK or overstaying on a visa
  • New measures to put an end to the never-ending cycle of legal challenges that can be used to thwart the deportation of people who have no legal right to be in the UK
  • Introducing scientific methods for age assessment to crack down on adults posing as minors
  • A new US-style Electronic Travel Authorisation scheme to keep criminals out before they even get here

Officers, prosecutors, caseworkers, and judges will be able to fully utilise these additional authorities after new instructions and training are implemented this summer.

Due to the immensity of the reforms, they will be implemented over the next few months and into the next year.

Royal Assent of the Nationality and Borders Act comes after Prime Minister, Mr. Boris Johnson, who announced a package of measures to tackle illegal migration earlier in April 2022.

This featured a world-first agreement with Rwanda to transport persons who arrived in the UK via unsafe or illegal routes, such as small boats or hidden in lorries, to Rwanda to have their asylum claims assessed and start a new life.
