The Home Office has issued new guidance on the CoS start date that Tier 2 sponsors need to take in to account when considering the start date for employment in the UK for Tier 2 employees.

The start date given on the CoS must be the date that the migrant employee will start working for the company in UK. The migrant will be granted entry clearance no more than 14 days before the start date given on the CoS. It is possible that once the entry clearance has been granted, the start date may be revised, however for Tier 2 (General) migrants, the start date cannot be revised by more than 4 weeks from the original start date on the CoS.

Tier 2 Intra Company Transferees can however have their start dates revised for a period exceeding the four weeks as long as they continue to remain employed with the company overseas.
