What is an adult dependant relative visa?

The adult dependant relative route is for applicants who need long-term care from a parent, grandparent, grandchild, brother, sister, son or daughter, who is settled in the UK, permanently.
The sponsor (relative) should meet one of the following:

  • They must either be a British or Irish citizen or,
  • They must either be settled in the UK on ILR, settled status or proof of permanent residency or,
  • They must be from the EU, Switzerland, Norway, Iceland, and Liechtenstein and have pre-settled status  – also, they must have started living in the UK before 1st January 2021 or
  • They must have refugee status or humanitarian protection in the UK

What is a dependant relative?

To qualify as an adult dependant relative, the applicant should meet the following criteria – 

  • Must be over 18 years of age
  • Must need long-term for everyday personal tasks because of disability, illness or age
  • The care needed is not available or affordable in your home country  
  • The sponsor (relative in the UK) can support, accommodate and care for you without any help from public funds for at least 5 years

The main challenges faced when applying for the UK is in meeting or proving that you can meet the above-mentioned eligibility criteria. Not meeting the criteria make the application weak, which is a challenge.

1. Mental Illness:

  • Older people are more likely to have mental problems than physical ones.

  • Mental illness is an important factor to consider when it comes to taking care of adult relatives. It can get hard to prove a mental illness unless you have medical records of the diagnosis. 
  • An important aspect to remember here is to maintain all the documents and medical records of the patient/applicant.

2. Evidencing Illness or disability:

  • Another great challenge in successfully applying for an adult dependant relative visa, is proving you cannot function or look after yourself because of a serious illness or disability. 
  • Your chances of a successful application depend on many factors like the level of illness or disability, whether you can look after yourself, whether you truly have no choice but to join your relatives in the UK, and so on…

3. Affordability:

  • One of the eligibility criteria is that you are eligible as long as the care needed is not available or affordable in your home country. 
  • But there are other factors that pitch in when the Home Office assesses an application. Such as, if you cannot afford the treatment or care in your home country, how will you manage it in the UK? And if you can, then why not here. 
  • But if the applicant has a specific disease or illness or disability that does not have any effective treatment in their home country, then the application may be valid.
