How to prove genuine and subsisting relationship for skilled worker dependent visa

Proving a genuine and subsisting relationship for Skilled worker dependent visa

Blog on Proving a genuine and subsisting relationship for Skilled worker dependent visa

Genuine and subsisting relationship for Skilled worker dependent visa – How to prove

Applicants for a number of UK visa options, including the Spouse Visa, Civil Partner Visa, and Unmarried Partner Visa, must provide proof that their connection is “genuine and subsisting.” When applying for a dependent visa, dependents of those who entered the UK through work or study-based channels must also show that they have a “genuine and subsisting relationship.” Numerous applications depend on these crucial criteria.

There are no mandatory paperwork, despite some portions of the immigration laws being highly particular about exactly what documents must be submitted to comply with each aspect of the immigration rules.

Our team based in India – Mumbai, Delhi and Bengaluru has received many queries about how dependants of skilled workers in the UK can meet the genuine and subsisting requirements. Here’s an extensive guide to meeting these requirements.

Bring your partner and children to the UK as dependents

If they qualify, your spouse and children may also apply to join you in the UK or continue living there as your “dependents.” They will each have to submit a separate application.

If their application is approved, their visa’s expiration date will coincide with yours.

Your partner

Will have to provide the following evidence to show a genuine and subsisting relationship for Skilled worker dependent visa:

  • You have a legally recognised civil union or marriage in the United Kingdom.
  • The time you apply, you’ve been in a committed partnership for at least two years.

Your partnership

Any of the following describe a partner or child who is dependent:

  • Your spouse, civil partner, or unmarried companion
  • If they were born in the UK during your visit, your child is under 18; if your child is over 18 and residing in the UK as your dependent
  • When you apply, you will be required to present proof of your relationship.

What is a Genuine and Subsisting Relationship and how to meet the requirements of subsisting relationship for Skilled worker dependent visa

Genuine and subsisting relationships are determined on a case-by-case basis; the Home Office considers all documentation, information and unique circumstances.

When determining the nature of a couple’s relationship and, more especially, whether their connection is sincere and ongoing, a decision-maker may consider a variety of variables. They consist of but are not limited to, proof that:

  • They are currently involved in a committed relationship;
  • Living together now or in the past;
  • They share parental responsibilities for their children, whether they be biological, adoptive, or stepchildren;
  • They are jointly responsible for their shared financial obligations, such as a joint mortgage or lease, a joint bank account, savings, and utility bills in both of their names.
  • The applicant, their partner, or both can give proof that they have visited each other’s native nation and families (the fact that an applicant has never visited the UK must not be regarded as a negative factor, but it is a requirement of the Immigration Rules that the couple have met in person)
  • They have established concrete plans for the couple’s ability to live together in the UK, or for their families to act on their behalf.
  • When a marriage is arranged, both the couple and the arrangements made by their families give their permission to the union.

What documents can you use to prove a subsisting relationship?

It is mandatory to provide evidence to show a genuine and subsisting relationship for Skilled worker dependent visa.

However, as per the guidelines for genuine and subsisting relationship for Skilled worker dependent visa from the Home Office, they will look for strong indications of ongoing communication, proof of cohabitation, companionship, emotional support, and a genuine concern for one another’s well-being.

When deciding what proof to offer, the guidelines for genuine and subsisting relationship for Skilled worker dependent visa from the Home Office suggests that the applicants should concentrate on providing documentation that may attest to both the reality of their relationship, which is founded on true affection or shared values and the fact that it is still running strong at the time of their application.

  • The birth or adoption certificates of any children they may have, together with the marriage or civil partnership certificate, are frequently the first documents many couples consult.
  • The types of paperwork advised in the Home Office guidance, such as lease agreements, bank statements, or invoices, are also typically relatively simple to use to demonstrate cohabitation.
  • While it is stated on the list that these should be in the names of both partners, it is normal for couples to split up the cost of bills or move into a home that only one of them owns.
  • These types of documents might just have one name listed on them in such circumstances. By supplying a selection addressed to each partner at the same address, it is still viable to rely on these documents in this situation.
  • Generally speaking, it’s a good idea to offer at least six of these documents for each partner (twelve altogether).

Are there any consequences if genuine relationship is not demonstrated?

Proving a genuine and subsisting relationship with the sponsor is essential for the dependent. The dependent visa pathway is primarily for partners of immigrants settled in the UK. Hence, meeting the requirement for genuine and subsisting relationship for Skilled worker dependent visa is mandatory.

If you fail to prove a genuine and subsisting relationship when applying as a dependent for a UK Skilled Worker visa, your visa application is most likely to get rejected.
